Wills and Succession in Telangana: Registration, Probate and Property Transfer
How succession works in practice in Telangana — registering a will, probate, family member certificates, mutating property after death, Bhu Bharati for land, and gift settlement deeds.
After a death, families in Telangana need to transfer property, bank accounts and investments to heirs. A clear will and good records make it far easier. This guide covers the practical steps in the state. Procedures and fees change, so check current requirements.
Registering a Will
A will can be registered with the Sub-Registrar in Telangana. Registration is optional, but it provides a safe record and strengthens the will against challenge. No stamp duty is payable on a will.
Probate
Probate hasn't been mandatory for wills made in Hyderabad or relating to property in Telangana, unlike some presidency towns. But courts, banks or buyers may still ask for probate or a succession certificate in disputed or high-value cases.
Proving Heirship
- A family member certificate issued by the Tahsildar lists the legal heirs.
- A succession certificate from a civil court may be needed for debts and securities where there's no will.
- Death certificates from GHMC or the local body.
Transferring Property
- Urban property: mutation in the property tax records with GHMC or the municipality.
- Agricultural land: mutation through the Bhu Bharati land records system, which replaced Dharani in 2025.
- Apartments: update the association and utility records.
Lifetime Transfers
Many Telangana families use gift settlement deeds to transfer property to children during their lifetime. These attract stamp duty, and Telangana provides concessional rates for settlements in favour of family members. Consider the loss of control before giving property away.
Personal Law
Hindu families follow the Hindu Succession Act, under which daughters have equal coparcenary rights. Muslim families follow Muslim personal law, with limits on bequests by will. Christian and Parsi families follow the Indian Succession Act.
