Hyderabad's pharma companies, IT firms, food brands and startups all live or die by their names, and a trademark registration is how you protect them. The rules are national, but a few details are specific to Telangana: which Trade Marks Registry handles your file, which courts you go to when someone copies your brand, and the state's own family of protected regional products. This guide covers all three.

Which Trade Marks Registry Handles Telangana?

Trademark applications are handled by regional offices of the Trade Marks Registry. The office with jurisdiction over Telangana is the Chennai office, which also covers Andhra Pradesh, Karnataka, Kerala, Tamil Nadu, Puducherry and Lakshadweep. It sits in the Intellectual Property Office Building on G.S.T. Road in Guindy, Chennai.

How jurisdiction is decided

Which office handles your application is not a choice. It is fixed by your principal place of business in India as stated in the application. A company in Hyderabad, Warangal, Karimnagar or Nizamabad therefore falls under Chennai. If you have no place of business in India, the address for service, for example your agent's address, decides it.

This makes one detail important: enter your correct Telangana address as your principal place of business on the application. An incorrect address can send the file to the wrong office and cause delays. Telangana was sometimes left out of older jurisdiction lists published before the state was formed, so check the date of anything you rely on.

You do not need to travel to Chennai

Almost all filings are made online on the IP India portal, and hearings and correspondence are handled electronically or through your agent. You can register a trademark from Hyderabad without visiting Chennai. A registration granted through the Chennai office protects your brand across India, including Telangana.

Sectors that file the most in Hyderabad

Hyderabad's economy shapes the classes its businesses need. These are examples, and you should confirm your own classes.

  • Pharmaceuticals and bulk drugs: Class 5, where existing registrations are dense and a deep search matters
  • IT and software: Classes 9, 35 and 42 for software, business services and software as a service
  • Biotechnology and life sciences: Classes 1, 5, 42 and 44, depending on the product or service
  • Food and restaurants: Classes 29, 30 and 43
  • Real estate and construction: Classes 36 and 37 for project names and group brands
  • Education and coaching: Class 41

Registering a Trademark from Telangana: The Practical Steps

The steps are the same as elsewhere in India. Our separate guide on how to register a trademark covers each in detail, and here is how they apply to a business in Hyderabad or elsewhere in Telangana.

  1. Search first. Check the IP India database for identical and similar marks in your class and in related classes. In crowded categories such as pharma, food and IT services, look at similar sounds and spellings too.
  2. Choose a distinctive name and the right classes. Descriptive names are hard to register.
  3. Decide the applicant. File in the name of the entity that will own and use the brand, such as your private limited company, LLP or partnership firm, rather than an individual founder, unless the founder is the owner.
  4. File Form TM-A online with your Telangana address as the principal place of business. You can file yourself with a Digital Signature Certificate or use a registered trademark agent or advocate, who need not be in Hyderabad.
  5. Pay the fee. ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for others, when filed online.
  6. Follow the file. Watch the portal for the examination report, reply within 30 days, and monitor publication and the opposition period.

Reduced fees for startups and small businesses

Telangana has a large startup ecosystem, with hubs such as T-Hub in Hyderabad, and many founders can use the reduced fee:

  • DPIIT-recognised startups qualify for the lower fee. Recognition is obtained through the Startup India portal.
  • Udyam-registered micro, small and medium enterprises also qualify, and Udyam registration is free.
  • Individuals pay the lower fee too.

You must submit the DPIIT or Udyam certificate when you file to claim the concession. If you are a private limited company and have neither certificate, the higher fee applies.

Other things a Telangana business should line up

  • A Digital Signature Certificate for online filing, which you may already hold for MCA or GST work
  • Domain names and social handles matching your brand, registered at the same time
  • Company and trade name consistency. Your registered company name, brand name and trademark should match, or you risk confusion
  • Evidence of use, such as invoices, packaging and listings, in case you claim prior use or face a challenge

Choosing help

Many Hyderabad firms and agents handle trademark work, and all the filing is online, so you can also use a provider elsewhere in India. Choose a registered trademark agent or advocate, ask for the total cost including the government fee, and insist on a documented clearance search before filing. Be careful about anyone who promises guaranteed registration, since only the Registry decides.

Protecting and Enforcing Your Brand in Telangana

If someone copies your brand

A registration lets you sue for infringement under Section 29 of the Trade Marks Act. An unregistered brand can rely on a passing-off action, but you must prove reputation. Some practical points for Telangana:

  • Start with a cease-and-desist notice from an advocate, and gather evidence such as photographs, listings, invoices and test purchases.
  • Where you sue. Trademark suits must be filed in a court not lower than a District Court that has jurisdiction. In Telangana, commercial IP disputes are heard under the Commercial Courts Act, and the Telangana High Court has a commercial division that deals with IP matters. Exactly which court is right depends on where the defendant operates, where the infringing goods are sold and the value of the claim, and the law on which court can hear these suits has been the subject of recent Supreme Court attention, so take advice.
  • Urgent relief. The Telangana High Court has recognised that trademark infringement often calls for urgent interim relief, and has held that such suits can be exempt from the pre-institution mediation step that normally applies to commercial suits, where the urgency is real. Your advocate will advise on this.
  • Police and criminal remedies. Counterfeiting can also be a criminal offence, and Telangana is among the states that have set up police units to deal with intellectual property crime. A police officer of the required rank may act after obtaining the Registrar's opinion.
  • Marketplace complaints. Online platforms have brand-protection channels, and a registration number makes takedown requests faster.

Challenges to your own registration

A competitor can also challenge your registration by applying for rectification or removal, for example on grounds of non-use for five years. Keep your records of use in order, and use the mark in the form in which you registered it.

Geographical Indications: Protecting Telangana's Regional Products

A trademark protects a business's brand. A Geographical Indication, or GI, protects a product's link to a place, so that only producers from that region can use the name. GIs are registered with the Geographical Indications Registry in Chennai, and they are owned collectively by producers, not by one company.

Telangana has more than a dozen registered GIs, the first being Pochampally Ikat in 2005. Registered examples include:

  • Hyderabad Haleem, registered in 2010 and reported as the first non-vegetarian dish in India to get a GI
  • Pochampally Ikat
  • Silver Filigree of Karimnagar
  • Cheriyal Paintings
  • Nirmal Toys and Crafts, Nirmal Furniture and Nirmal Paintings
  • Pembarthi Metal Craft
  • Gadwal Sarees and Narayanpet Handloom Sarees
  • Siddipet Gollabhama
  • Puttapaka Telia Rumal
  • Adilabad Dokra and Warangal Durries
  • Tandur Red Gram
  • Hyderabad Lac Bangles

More applications are pending. A GI registration lasts 10 years and can be renewed.

GI and trademark together

If you sell a GI product, such as ikat sarees or handicrafts, you can combine both protections. The GI protects the regional name, while your own brand name and logo are protected by a trademark. Producers' associations, cooperatives and artisan groups in Telangana can also consider certification or collective marks.

A Checklist for Telangana Businesses

A Hyderabad startup: search the name, register a DPIIT recognition or Udyam certificate to use the lower fee, file the word mark and logo in the right classes, secure the domain and social handles, and use ™ from the day you file.

A pharma or biotech company: run a deep search in Class 5 and related classes, file for each product brand as well as the house brand, and monitor the Journal for similar marks.

A restaurant, cloud kitchen or food brand: file in Classes 29, 30 and 43 as relevant, and remember that an FSSAI licence does not protect the brand name, so register the trademark separately.

An IT or SaaS company: file in Classes 9 and 42, plus 35 if you offer business services, and protect product names as well as the company name.

An artisan, weaver or handicraft business: check whether your product is covered by a Telangana GI, and register your own brand as a trademark, or a collective or certification mark if you work through an association.

A franchisor or reseller: make sure the mark is registered before you license it, and keep the licence agreement in writing.

A sensible order

  1. Search and choose the name.
  2. Get your DPIIT or Udyam certificate if you qualify.
  3. File Form TM-A online with your Telangana address as the principal place of business.
  4. Watch the portal and reply to any examination report within 30 days.
  5. Monitor the Journal for conflicting marks, and oppose them within the window.
  6. Use the mark, keep records, and renew in year ten.

Mistakes Telangana Businesses Make

  • Using the wrong address on the application, which can send the file to the wrong office or cause delays
  • Confusing company registration with trademark protection. A company name from the Registrar of Companies does not give you brand rights
  • Filing only in one class, for example only Class 9 for a software business that also offers cloud services
  • Skipping the search, especially in busy categories such as pharma, food and IT
  • Missing the 30-day reply window for an examination report
  • Claiming the startup fee without a certificate
  • Treating a GI as a substitute for a brand. A GI protects a place-based name, not your own brand
  • Not acting quickly on copycats. Delay makes injunctions harder to get

This guide is general information, not legal advice. Trademark fees, rules and court procedure change, so confirm current details on the IP India portal or with a registered trademark agent or advocate before you file.
