Two licences come up for almost every business with an office or shop: registration under the state's Shops and Establishments Act, and a trade licence from the municipality. They're often confused, but they're different. This guide explains both.

Shops and Establishments Registration

Each state has its own Shops and Establishments law, regulating conditions of work in shops, offices, hotels, restaurants and other commercial establishments. Registration is usually with the state's labour department, and is required within a set period of starting the establishment.

What it covers

  • Working hours, weekly holidays, and overtime.
  • Leave and holidays.
  • Employment of women and young persons.
  • Registers of employees, wages, and attendance.

Some states exempt very small establishments or have simplified registration. The law applies based on where the establishment is located.

Why it matters beyond labour law

Banks often accept it as proof of business for opening a current account, especially for proprietorships.

Trade Licence

A trade licence is issued by the municipal corporation or local body, permitting a specific trade or business at a specific premises. It's about the premises and the local area's rules — safety, sanitation, zoning — rather than employment.

  • Usually renewed annually.
  • Tied to the premises, so a move needs a new or amended licence.
  • Fees often depend on the type of trade and the size of premises.

The Difference

  • Shops and Establishments: a state labour law registration, about employees and working conditions.
  • Trade licence: a municipal licence, about the premises and the activity carried on there.

Many businesses need both.

Ongoing Obligations

  • Display the registration and licence at the premises.
  • Maintain employee registers.
  • Renew on time.
  • Update registrations when the premises or employee numbers change.
