Points Telangana businesses should get right in their income-tax returns: state levies under Section 43B, state incentives, and where disputes are heard.

Income tax is a central tax, and the return is the same for a business anywhere in India. But several items in a Telangana business's return come from state-level payments and incentives, and disputes are heard by local appellate bodies. This guide covers the Telangana side.

Note: this article covers the rules for FY 2025-26 under the Income-tax Act, 1961. The Income-tax Act, 2025 applies from tax year 2026-27, with renumbered provisions and some changes, so check the current position for later years.

State Levies and Section 43B

Taxes and duties are deductible only when actually paid. For a Telangana business, the ones to watch are:

  • Professional Tax: the business's own enrolment tax is deductible when paid; amounts deducted from employees must be deposited on time.
  • Telangana State GST expensed rather than credited, such as on blocked credits.
  • Property tax to GHMC or the local municipality.

Amounts not paid by the return due date aren't deductible for that year.

Payments to MSME Suppliers

Telangana has a very large number of micro and small enterprises. Amounts owed to them beyond the time allowed under the MSMED Act aren't deductible until paid. Checking which suppliers are Udyam-registered, and paying them on time, protects the deduction.

State Industrial Incentives

Businesses receiving incentives under Telangana's industrial policies — such as capital subsidies, power cost reimbursements, or tax reimbursements — need to treat them correctly. Broadly, a subsidy linked to an asset may reduce its cost for depreciation, while others may be taxable income. The treatment depends on the incentive's nature and purpose.

Jurisdiction and Appeals

Scrutiny assessments are largely faceless, so where you're located matters less for assessment itself. But appeals beyond the Commissioner (Appeals) go to the Income Tax Appellate Tribunal, which has a bench in Hyderabad, and further appeals on questions of law to the High Court for the State of Telangana.

A Checklist for Telangana Businesses

  1. Pay Professional Tax, property tax and other state levies before the return due date.
  2. Identify MSME suppliers and pay them within the time allowed.
  3. Get the tax treatment of state incentives right.
  4. Reconcile GST turnover with the return.
  5. File by the due date to keep losses available.
