Capital Gains on Property in Telangana: Market Value, Registration and Exemptions

How capital gains on Telangana property are computed: the state's market value, TDS by buyers, agricultural land near Hyderabad, and reinvestment exemptions.

Hyderabad's property market has made capital gains a common concern for Telangana residents — families selling inherited land, professionals upgrading flats, and investors exiting plots. The tax rules are national, but several Telangana-specific factors affect the outcome. This guide covers them.

Note: this article describes the rules under the Income-tax Act, 1961. The Income-tax Act, 2025 applies from 1 April 2026 (tax year 2026-27), with renumbered provisions, so check the current position for later periods.

The State's Market Value

When property is registered, the Telangana Registration and Stamps Department values it for stamp duty using its market value guidelines. For income tax, if this stamp duty value is higher than the actual sale price, beyond a tolerance, it may be treated as the sale price. If you believe the stamp duty value is too high, there's a route to have the property valued by a valuation officer.

Choosing Between Rates

For land or buildings acquired before 23 July 2024, resident individuals and HUFs can choose between 12.5% on the gain without indexation, and 20% on the indexed gain — whichever gives lower tax. For older properties bought when prices were much lower, indexation often helps.

Inherited Property

For property received by inheritance, the cost is the previous owner's cost, and the holding period includes the previous owner's period. For property acquired before 1 April 2001, fair market value on that date can be used as cost.

Agricultural Land Near Hyderabad

Rural agricultural land located outside the specified distances from municipal limits isn't a capital asset, so its sale isn't subject to capital gains tax. As Hyderabad expands, land that was once rural may now fall within the specified distances. The location and municipal boundaries at the time of sale matter.

TDS by the Buyer

A buyer paying ₹50 lakh or more for immovable property other than agricultural land must deduct TDS. If you're an NRI seller, much higher withholding applies, and a lower deduction certificate may help.

Reinvestment Exemptions

  • Buying or constructing a residential house within the time limits, subject to a cap.
  • Investing in specified bonds within six months, up to a limit.
  • Depositing unused amounts in the Capital Gains Account Scheme before the return due date, if the house isn't bought yet.

A Checklist for Telangana Sellers

  1. Compare the sale price with the stamp duty value.
  2. Compare the with- and without-indexation options.
  3. Check whether agricultural land is a capital asset.
  4. Plan reinvestment before the deadline.
  5. Pay advance tax on the gain in the next instalment.
